These terms explain when and how Hyvery may send you marketing and informational messages by emailand SMS/MMS (A2P). By opting in, you agree to the terms below, our Privacy Policy, Terms of Service, and any program‑specific disclosures at the point of collection.
Email Marketing: newsletters, product updates, events, offers.
SMS/MMS Alerts (A2P): “Hyvery Alerts” (marketing and info), and account‑related notices (e.g., security, maintenance).
Transactional messages (e.g., password resets, security alerts, critical service notices) may be sent regardless of marketing opt‑in to administer the service you use.
Email: You provide consent by submitting a form with an unchecked consent box that you actively select, or by confirming via a double‑opt‑in email.
SMS/MMS: You provide consent by (i) entering your mobile number and checking the consent box; (ii) texting a program keyword to our A2P 10DLC number; or (iii) replying Y/YES to a confirmation message (double opt‑inwhere required).
Not a condition: Consent to marketing is not a condition of purchase or of using our services.
Age: You confirm you are 18+ (or 13–17 with parental/guardian consent).

Email: “By checking this box, you agree to receive marketing emails from Hyvery. You can unsubscribe at any time.”
SMS: “By entering your number and clicking ‘Agree & Join’, you consent to receive recurring automated marketing texts from Hyvery at the number provided. Consent not a condition of purchase. Reply STOP to cancel, HELP for help. Msg & data rates may apply. Msg freq varies. See Terms & Privacy.”
Frequency: Varies by program (typically 2–6 msgs/month for marketing; higher for opt‑in alerts).
Fees: Message and data rates may apply.
Carriers: Delivery subject to your carrier’s availability; carriers are not liable for delayed or undelivered messages. Messages are sent via registered A2P 10DLC numbers.
Email: Click Unsubscribe at the bottom of any email or visit our Preferences Center.
SMS/MMS: Reply STOP (or END, CANCEL, QUIT, UNSUBSCRIBE) to end all marketing texts from that program. You may receive a final confirmation (“You have been unsubscribed”).
HELP: Reply HELP for assistance or contact support@hyvery.com or 1‑833‑HYVERY‑0.
Re‑subscribe: Text the original program keyword again or re‑opt‑in on a form.
Processing time: We process opt‑outs promptly (email within 10 business days; SMS immediately or within 24 hours).
We may use your name, email, phone number, organization, role, and interaction history (opens/clicks, reply keywords) to operate messaging programs, improve relevance, and comply with laws. See our Privacy Policy for details on data use, retention, and your rights.
U.S. (TCPA/CTIA/CAN‑SPAM): We obtain express consent for automated texts; maintain opt‑in records (timestamp, source, IP/keyword); include brand identification and opt‑out instructions in every message. Email includes identification and an unsubscribe link.
Canada (CASL): We obtain express consent for commercial electronic messages and include sender ID and a working unsubscribe mechanism; we honor opt‑out within 10 business days.
EU/UK (GDPR/ePrivacy/PECR): We rely on consent for direct electronic marketing to individuals unless a soft opt‑in applies under local law; you may withdraw consent at any time. Data subject rights are supported via our Privacy Requests portal.
We log consent and opt‑out events (channel, timestamp, source, payload) and retain them per our retention schedule.
We secure mailing/SMS lists and do not sell personal information. Sub‑processors (e.g., email/SMS providers) are bound by data processing terms and security controls.

If YES, activation confirmation is sent; if NO or no response, no further marketing texts are sent.
Every SMS includes: Hyvery (brand), optional program tag (e.g., [Hyvery Alerts]), and opt‑out text (“STOP to opt out, HELP for help”).
